BEAVERCREEK, Ohio — The co-founder and CEO of Buc-ee’s has spoken out about the lawsuit the company filed against an Ohio mini-mart.
Arch Aplin spoke with WHIO on Thursday to explain why the company filed the civil lawsuit against Beaver’s Mini Mart in Beavercreek, Ohio.
Aplin said the company took “no pleasure” in filing the suit but only did so after attempts to communicate with Beaver’s Mini Mart owner, Vik Singh, went unanswered for months.
He said the nationwide chain of convenience stores used registered mail, phone calls and emails, but Singh did not respond until an attorney for Beaver’s Mini Mart contacted Buc-ee’s shortly after 6 p.m. Thursday, saying they were ready to talk, WHIO reported.
Aplin claimed Beaver’s Mini-Mart was the aggressor for filing its own federal trademark application, similar to the trademark Buc-ee’s has held for years.
He added that to protect the Buc-ee’s trademark, they had to file the lawsuit, and if the company didn’t, Beaver’s Mini-Mart could end up in control of Buc-ee’s trademark.
Alpin told WHIO that if Beaver’s Mini-Mart withdrew its application, Buc-ee’s would drop the lawsuit.
The owners of Beaver’s Mini-Mart told WHIO in a prior statement that the lawsuit filed by the national chain was unfair and that they would contest it.
