Buc-ee’s is suing a small-town mini mart for trademark infringement, saying that its beaver is too close to the massive convenience store chain and could cause confusion.
Buc-ee’s is suing Beaver’s Mini Mart in Beavercreek, Ohio, which now has two weeks to respond, WHIO reported.
The lawsuit says “Like the Buc-ee’s Marks, Defendant’s Marks incorporate a cartoon beaver with wide eyes and a smile,” and that the small store uses a similar red color to that of the chain.
Buc-ee’s says the similarities are “likely to cause confusion” for customers, who are “likely to perceive a connection or association.”
The mini mart is a small location and does not have fuel, unlike Buc-ee’s, which frequently has 120 gas pumps.
Beaver’s Mini Mart released a statement that called the lawsuit unfair.
“We want to take a moment to thank you-our amazing customers and the Beavercreek community-for your unwavering support over the years. You may have heard that we are currently facing a lawsuit filed by Buc-ee’s for simply using a beaver in our store name and branding. We created Beavers Mini Mart to represent our connection to this community and the city we proudly serve-Beavercreek. This lawsuit is unfair, and we believe small businesses should be able to operate without being bullied by large corporations. We are standing up for our rights and will fight this lawsuit all the way,” the mini-mart owner said in a statement to WHIO.
The small business is getting help from the community in its fight with the massive chain.
Cake Hope and Love Bakery is making beaver cookies, with part of the proceeds going to the mini mart.
“As soon as we put some on the counter, they’re gone the next minute,” bakery co-owner Jaclyn Meyer told WHIO.
“For them to have that hanging over their head, I am sure they weren’t sleeping at night. So, I’m hoping that they wake up feeling very loved on and supported. That the entire town is literally turning out for them,” bakery co-owner Shannon Teague said.
A local T-shirt company is selling shirts to help fund some of the store’s legal fund.
There’s also a GoFundMe set up to help offset the legal bills. As of Thursday morning, it had raised $35,552 over only three days. The organizer wrote, “We need your help to keep our small town community Beaver’s Mini Mart open. By donating, you are taking a stand with us to ensure that small mom and pop stores—like Beaver’s Mini Mart, the backbone of America—are not swallowed up by big businesses,” calling the store “the heart of our community.”
