Jury finds county not responsible in Green River crash that killed 2 boys

The VW Beetle that went into the Green River with two children inside is pulled from the water Tuesday.
A jury has found that King County was not negligent in the design of a road where two boys died in 2008 after the car they were in plunged into the Green River.

The family of one of two boys killed in the crash into the Green River had sued King County, saying poor design and maintenance of the narrow rural road played a role in the accident.

Austin Fuda, 13, and his cousin, 2-year-old Hunter Beaupre, were in a car driven by Austin’s 16-year-old stepsister on Nov. 7, 2008, when she lost control of the car on Green River Road Southeast in the Auburn area.

The Volkswagen Beetle plunged into the fast-moving river. Only the 16-year-old survived and it was several days before the car and the boys' bodies could be recovered.

The lawsuit was filed by Austin’s parents, James and Keleighn Fuda, more than three years after the crash.

Police reports say the road was wet and covered with leaves when the car went off the road and into the river. The complaint filed by the Fudas said the narrow road was poorly designed and maintained.

The verdict was read late Friday morning.
