Crystal Thomas, 33, of Highland, New York, was charged with endangering the welfare of a child following her Oct. 4 arrest, Mid-Hudson News reported.

Lloyd Chief of Police James Janso told the Daily Mail that the boy obtained the body art while staying in a motel with his mother and older sibling. Thomas is accused of giving the child permission to have a man in a neighboring room administer the tattoo: the child’s name inked in block letters about 6 to-8 inches long across his forearm.

According to the New York State Department of Health, regulations are currently being developed for statewide health regulations for tattooing and body piercing, which will fall under Public Health Law Article 4A, WRRV reported.

It is currently a violation of Section 260.21 of New York State Penal Law to tattoo minors under the age of 18, regardless of parental consent being granted, the radio station reported.

Thomas was released on an appearance ticket, according to Mid-Hudson News.
