REDMOND, Wash. — Pieces of their houses are falling off -- is what a lawsuit filed Friday against developer Shea Homes in federal court alleges. Nearly a thousand homeowners at senior living development Trilogy allege that improper waterproofing during construction has led to rotting decorative beams and window frames.
“We think this is the best community in the state of Washington. We’re just disappointed there were mistakes made,” Dale Stirn said.
His attorney Dave von Beck said the work done during construction was not up to code and for that reason, all his client’s homeowners insurance will not cover the repairs.
The developer’s attorney said in a statement late Friday: “We continue to work directly with homeowners to resolve any issues.”
However, this lawsuit is the third Shea Homes is facing from the homeowner. There were two major mold lawsuits, one settled for a total of $2.4 million two years ago.
This time the attorneys said damages could be between $30-80 million, depending on punitive damages. Shea is also developing two other properties in western Washington currently in Bonney Lake and Lacey.
