Florida man headbutts police officer when ordered out of no-swim zone in Keys

A South Florida man on Sunday reportedly told deputies who made him leave the water at a resort's no-swim zone they would end up on the news for harassing him.

Yanser Robaina, of Homestead, was partially right. The 40-year-old made headlines after kicking the door of a patrol car, headbutting a deputy and then spitting into the officer's mouth, the Miami Herald reported.

According to the Monroe County Sheriff's Office, Robaina was charged with felony counts of battery on an officer, resisting an officer with violence and property damage exceeding $1,000. Robaina also faces a misdemeanor charge of resisting an officer and obstruction without violence.

Deputies were called to Gilbert's Resort in Key Largo, WTVJ reported. According to a report by Deputy Ignacio Molina, he told some children to stop jumping in the water off the resort's marina because of boat traffic. The area also was marked as a no-swim zone, and when Molina told Robaina and another man also to leave the water, the deputy said Molina cursed at him, the Herald reported.

Molina also wrote in his report that Robaina told him, "I am going to sue you guys, and you (are) going to end up on the news," according to the Herald.

Robaina was then handcuffed and allegedly fought with deputies and damaged the patrol car when he was put in the back seat, kicking the door from the inside so it could not be shut, the newspaper reported.

When Molina got behind Robaina to help secure leg restraints, the deputy was headbutted and Robaina spat in his mouth, according to the arrest report. Molina then used a stun gun to subdue Robaina, WTVJ reported.

Robaina is scheduled to appear in court July 25, according to the Monroe County Sheriff's Office.
